Understanding Same-Sex Divorce and Custody in New Mexico

Same-sex married couples who decide to divorce in New Mexico are subjected to the same legal process and same legal authority to which opposite-sex couples are subjected.  Property and debt will be divided according to New Mexico Community Property Law.  Spousal support considerations will assess the financial need of one spouse and the ability of the other spouse to pay.  Child support will be calculated in accordance with the New Mexico Child Support Guidelines.  Custody and Visitation will be determined in keeping with the best interests of the children.
